EXHIBITOR Application Terms and Conditions

TERMS AND CONDITIONS

The Elsi-Con (“Elsi-con”) wants to have a well-rounded event with Exhibitors and Artist Alley Creators (“Vendors”) in numerous categories selling quality products that the consumers are looking for. The audience that Elsi-con will reach is age 5 to 95 – consumers, financially comfortable, collectors, families, gamers, and fans of all things comic-centric.

This agreement, once approved, is for space at the Elsi-Con, at the Chief Young Eagle Recreation Centre in Elsipogtog, New Brunswick. It is expressly understood that nothing herein shall confer any rights or duties upon the vendor with respect to subsequent exhibitions conducted by the Elsi-con. Vendors acknowledge and understand that vending at this event does not guarantee Vendors the right to vend in any future shows produced by the Elsi-con. It is further understood that Elsi-con shall have the right to reject any contract and deny entry to any Vendor at any time up to 24 hours prior to the date of the show and upon the Elsi-con’s return of any payments made by Vendors neither party shall have any further rights obligations or liability regarding the other.

Applying for space and accepting these terms does not guarantee Vendors space at this event. Upon acceptance, Elsi-con will furnish an applicant with confirmation of space, load in and load out procedures, dates, and times. Set up, show times and security will be strictly enforced to make this a good show for Vendors and attendees.

The total amount payable to the Elsi-con under this agreement is detailed in the Vendor’s application. Once your application is approved, the payment for space is due. No Vendors will be permitted to enter the show floor unless the balance due to the Elsi-con for space is current and paid in full. Failure to pay in full will result in the loss of your space at the Elsi-con.

The Elsi-con, at its sole discretion, shall assign space at the show and we will try to accommodate special requests. Vendors will only be allowed to use the space it is assigned. No space will be assigned without an order and a deposit. The Elsi-con reserves the right to rearrange the floor plan altar entrances and exits and undertake structural changes as needed.

Cancellations must be communicated via email or in writing at least seven (7) days in advance of the event or any Vendor fees will be forfeit.

Vendors will limit their display to the rented table space and a reasonable distance behind that space that is deemed “theirs” and will not alter the convention floor plan in any way. No Vendor will be or is allowed to have any item(s) in the aisle space of the convention floor without PRIOR approval of the authorized convention liaison.

Vendor displays shall not inhibit the view of other Vendors. If this occurs, you will be asked to adjust your display.

If your display includes sound, music, lights, or videos, Elsi-con staff reserves the right to ask you to lower the volume or adjust the display so as not to impact other vendors or attendees.

The buying and selling of counterfeit / knock-off / unlicensed materials is not tolerated at the Elsi-con. Elsi-con is a celebration of the best of popular culture, and bootlegs have no place in the expo. Non-compliance with this condition will result in one and only one warning. A second violation and you’ll be removed from the show.

Material produced by Artificial Intelligence (AI) may be on display at the Expo, but only as Not-For-Sale (NFS). It must be clearly marked as AI-produced, not simply listed as a print. Non-compliance with this condition will result in one and only one warning. A second violation and you’ll be removed from the show.

The space Vendors purchase is for your use ONLY. NO SUBLETTING and OR RESELLING of space is allowed.

Vendors must comply with all federal, provincial, and municipal laws.

Sales tax is the responsibility of Vendors to collect according to provincial laws. It is your responsibility to comply with provincial laws.

Material produced by Artificial Intelligence (AI) may be on display at the Expo, but only as Not-For-Sale (NFS). It must be clearly marked as AI-produced, not simply listed as a print.

Vendors will not and are not permitted to affix anything to the convention room walls. Any damage to the facility NOT reported to the Elsi-con before 10:00 AM AST on the morning of the show will completely be the responsibility of Vendors occupying the space; and said Vendor will be held personally responsible for said damage.

Vendors assume entire responsibility and hereby agrees to protect, indemnify, defend, and save the Elsi-con harmless against all claims, losses and damages to person or property, governmental charges and or fines and attorney fees arising out of or caused by Vendors installation, removal, occupancy or use of the exhibition premises or any part thereof.

Vendors agree to hold the Elsi-con harmless from loss or damage of merchandise or injury sustained during attendance at its events. The Elsi-con takes no responsibility for items lost or stolen – it is up to Vendors to carry insurance for their goods.

Vendors understand that Elsi-con does not maintain insurance covering Vendors, their employees, family or helpers, or Vendor’s property, and it is the sole responsibility of Vendors to obtain such insurance should Vendors want or need such insurance.

Vendors and their staff shall not defame, slander or otherwise harm the integrity of the Elsi-con through spoken, physical, electronic, written or any other means, at any time. Should a vendor be found to be in violation, this will result in expulsion from the convention without reimbursement of monies paid, and they will not be permitted to return in future years.

There will be security on premises, however Elsi-con will not be responsible for Vendor’s property. Be vigilant, not paranoid, and help each other if needed.

No items that are immoral, illegal, or dangerous will be allowed – if any Elsi-con representative feels any articles / products are questionable, removal will be requested – non-compliance will result in the vendor being asked to leave.

Vendors and their employees are expected to display professionalism, courtesy, and respect, when speaking or dealing with ANY attendee, guest, Vendor, or artist.

Elsi-con RESERVES THE RIGHT TO DENY EXHIBITOR / CREATOR ACCESS TO ANY EVENT IF THE COMPANY FEELS THAT PARTICIPATION BY A GROUP OR INDIVIDUAL WILL HARM THE EVENT OR OUR COMPANY IN ANY MANNER. THE Elsi-con WILL BE THE FINAL ARBITER IN THESE CASES. THIS INCLUDES SUBLETTING SPACE FOR THE SHOW.
